By creating an account or using Waitlist OS ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Waitlist OS.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Waitlist OS is a software-as-a-service (SaaS) platform that enables founders and businesses to create and manage waitlists with built-in referral mechanics, automated email notifications, subscriber analytics, AI-generated thank-you pages, custom fields and surveys, talent discovery (hiring mode with CV uploads), and promotional media (images and video).
The Service is offered on a subscription basis with multiple tiers, each providing different features and subscriber limits. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@waitlistos.com if you suspect unauthorized access to your account.
You may not share your account with others, create accounts using automated methods, or create more than one account per person unless expressly permitted.
Waitlist OS offers the following subscription plans:
Paid subscriptions are billed monthly in advance via our payment processor, Lemon Squeezy. All prices are in US dollars. By providing a payment method, you authorize us to charge the applicable fees on a recurring basis.
Subscription fees are non-refundable except as described in Section 5 (Refund Policy). We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
If payment fails, your account may be downgraded to the Free plan. You remain responsible for any unpaid amounts.
We offer a 7-day refund window from the date of each billing charge. If you are unsatisfied with the Service within 7 days of a charge, you may request a full refund for that charge.
Refund requests must be submitted by email to hello@waitlistos.com with the subject line "Refund Request" and your account email. Refunds are processed within 5 business days and returned to the original payment method.
Refunds will not be issued after the 7-day window, for partial months, or for usage of features that are subsequently removed. See our Refund Policy page for full details.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.
The Service, including all software, designs, text, graphics, and other content created by Waitlist OS, is owned by us and protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own business purposes in accordance with these Terms.
You retain ownership of all content you create using the Service, including your waitlist pages, subscriber data, and custom branding. By using the Service, you grant us a limited license to host, store, and display your content as necessary to provide the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.
You are responsible for ensuring that your collection and use of subscriber data complies with all applicable privacy laws, including GDPR where applicable. You must have a lawful basis for collecting subscriber email addresses and must provide appropriate notice to your subscribers.
To the maximum extent permitted by applicable law, Waitlist OS and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
You may cancel your subscription and close your account at any time through your billing settings or by emailing hello@waitlistos.com. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees. Upon termination, your right to use the Service ceases and we may delete your data after a reasonable retention period.
We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
These Terms are governed by the laws of Sri Lanka, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
